1 . Acceptance of the Terms
By accessing or using any product, website or online service provided by Inflamed Games - including our video-game titles Proficient Paddles, Robotical Escape and any future games, their companion websites, downloadable content, support portals or other applications delivered through PCs, consoles, mobile devices or third-party storefronts (collectively the “Services”) - you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use the Services.
2 . Age Ratings & Age Restrictions
Each Game carries an official age rating (PEGI, ESRB, or an equivalent local scheme). You may access, download or purchase a Game only if you meet the minimum age for your region (e.g. PEGI 3, PEGI 12, PEGI 18). We collect gameplay telemetry that is anonymised and cannot identify you; this may include data from players under 13. We do not knowingly collect personal data from children under 13 without first obtaining verifiable parental consent.
3 . Licence to Use the Games
- Inflamed Games grants you a personal, non-exclusive, non-transferable, revocable licence to download, install and play one copy of each Game for non-commercial entertainment on a device you own or control.
- This licence terminates automatically if you breach these Terms, any End-User Licence Agreement (EULA), or the rules of the digital storefront from which you obtained the Game.
- All intellectual-property rights in the Games and their content remain the property of Inflamed Games or its licensors; no ownership rights are transferred to you.
- Streaming & Let’s Plays: You may capture, upload and/or stream gameplay footage or screenshots for non-commercial or ad-supported content (e.g. Let’s Play videos, Twitch streams) provided you do not charge viewers to access the footage and you credit the Game title.
- Modding: Unless we provide an official modding kit or give written permission, you must not modify, translate, reverse-engineer or create derivative works of any Game.
- No rental, resale, or sublicensing: You may not rent, lease, lend, resell, sublicense or otherwise distribute the Game or any activation keys.
- Technical-protection measures: You agree not to bypass, disable or interfere with any digital-rights-management, anti-tamper or anti-cheat systems that safeguard the Game.
- Updates & DLC: All patches, updates and downloadable content are licensed-not sold-on the same terms as the base Game.
4 . Purchases & Refunds
- Third-party storefronts. Any purchase you make through an external store or platform (e.g. Steam, Nintendo eShop, Microsoft Store, PlayStation Store) is governed by that store’s own terms, payment methods and refund rules. All billing queries - including refund requests - must be directed to the storefront.
- UK consumer rights. Your statutory rights under UK consumer law - including the right to a repair, replacement or refund for faulty digital content - are not affected by these Terms or by the storefront’s policy.
- Non-transferable. Purchases and any associated activation keys are for your personal use only and may not be resold, transferred or exchanged.
5 . Prohibited Conduct
- Employ cheats, hacks, bots, automation software or any other tool designed to gain an unfair advantage.
- Modify, decompile, reverse-engineer, or attempt to extract source code from the Games or their files.
- Rent, lend, resell or otherwise distribute the Games, activation keys or in-game items.
- Bypass or disable any digital-rights-management, anti-cheat or security measure.
- Use the Services for any unlawful, defamatory, harassing, hateful or otherwise harmful purpose.
6 . Availability, Updates & Suspension
- Updates and patches. We may release updates, hot-fixes or new versions of any Game at any time. These may be required for continued play and may modify or remove certain features.
- Service changes. We reserve the right to modify, suspend or discontinue any part of the Services (including online features) without notice.
- No liability for downtime. Inflamed Games is not liable for any loss of progress, data or other harm that results from server outages, maintenance windows, or the retirement of a Game or feature.
7 . Intellectual Property
- Ownership. All trademarks, logos, artwork, music, code, narrative and other content appearing in the Games or on our websites are the property of Inflamed Games or its third-party licensors.
- No transfer of rights. Except for the limited licence granted in Clause 3, these Terms confer no ownership or intellectual-property rights to you.
- Brand usage. You may not use the Inflamed Games name, logo, or game titles in any commercial manner without our prior written consent, except as permitted under the Streaming & Let’s Plays bullet in Clause 3.
- Infringement claims. If you believe any content we host infringes your copyright or other rights, please email [email protected] with full details so we can investigate and, where appropriate, remove or disable the material.
8 . Feedback
By submitting any feedback, suggestions, bug reports or other ideas regarding the Games or Services (“Feedback”), you grant Inflamed Games a world-wide, perpetual, irrevocable, royalty-free licence to use, copy, modify, publish, translate and create derivative works from that Feedback for any purpose-commercial or otherwise-without obligation to credit or compensate you.
9 . Disclaimer of Warranties
The Services are provided “as is” and “as available.” To the maximum extent permitted by applicable law, Inflamed Games expressly disclaims all warranties and conditions-whether express, implied or statutory-including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, satisfactory quality, non-infringement, and the continuous, error-free, secure or virus-free operation of the Services.
10 . Limitation of Liability
To the fullest extent permitted by law, Inflamed Games, its directors, employees and partners shall not be liable for any indirect, incidental, special, consequential or exemplary damages arising out of or in connection with the Services-even if we have been advised of the possibility of such damages.
In any event, our total aggregate liability to you for all claims in any twelve-month period shall not exceed the greater of:
(a) £50 (fifty pounds sterling); or
(b) the total amount you actually paid us for the affected Service during that twelve-month period.
This cap applies to all causes of action, whether in contract, tort (including negligence), strict liability or otherwise.
11 . Indemnity
You agree to indemnify, defend and hold harmless Inflamed Games, our directors, employees and partners from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in any way connected with: (i) your breach of these Terms or any applicable EULA; (ii) your violation of any law or the rights of a third party while using the Services; or (iii) any content you upload, stream or otherwise make available that infringes intellectual-property or other rights.
12 . Termination
- By Inflamed Games. We may suspend or terminate your access to any part of the Services-immediately and without prior notice-if we reasonably believe you have violated these Terms, any EULA, the rules of a digital storefront, or otherwise pose a risk to the community or to the integrity of the Games.
- Effect of termination. On termination you must cease all use of the affected Game(s), uninstall any copies, and delete any backup files. Provisions that by their nature should survive-such as intellectual-property ownership, disclaimers, liability limits and governing-law clauses-will remain in force.
- By you. You may terminate this licence at any time by uninstalling the Game(s) and deleting all copies.
13 . Governing Law & Jurisdiction
These Terms-and any dispute or claim arising out of or in connection with them or the Services-are governed by the laws of England & Wales. The courts of England & Wales shall have exclusive jurisdiction to settle any such dispute or claim, except that mandatory consumer-protection laws may allow you to bring an action in the country where you reside.
14 . Changes to the Terms
- Notification. We may update these Terms at any time by posting the revised version on our websites. The “Last revised” date at the top of the document will change accordingly.
- Continued use. By continuing to access or use the Services after the revised Terms are posted, you accept the updated Terms. If you do not agree, you must stop using the Services and uninstall the Games.
